1. Booking & Payment

A booking is confirmed only once a signed agreement and a non-refundable booking fee (retainer) have been received.

The remaining balance must be paid no later than 7 days before the session or event date (unless otherwise agreed in writing).

Failure to pay the balance may result in cancellation of services.

All payments are non-refundable except in the unlikely event that Lola Garcia Photography is unable to attend due to serious illness or

unforeseen circumstances.

2. Cancellations & Rescheduling

If the client cancels, the booking fee is non-refundable.

Rescheduling requests may be accommodated at the photographer’s discretion and subject to availability.

For weddings and large events, rescheduling may require a new booking agreement.

3. Delivery of Images

Delivery times vary depending on the service:

  • Headshots & branding: typically within 5–10 days

  • Weddings: typically within 2–4 weeks

  • Corporate events: typically within 3–10 days

Delivery timelines are estimates and may vary during busy periods.

Images are delivered digitally via an online gallery.

4. Artistic Style

The client acknowledges that they are familiar with Lola Garcia Photography’s style and portfolio.

Editing style, composition, and artistic decisions remain at the photographer’s discretion.

RAW files are not provided.

5. Image Selection (Where Applicable)

For sessions that include client image selection, the gallery will remain active for a limited period.

If selections are not made within the stated timeframe, the photographer may choose images on the client’s behalf.

6. Client Cooperation

The client is responsible for:

  • Arriving on time

  • Securing necessary permissions for locations

  • Ensuring guests or participants cooperate

Missed moments due to lack of cooperation, lateness, or venue restrictions are not the responsibility of the photographer.

7. Usage & Copyright

All images remain the copyright of Lola Garcia Photography.

Clients receive a personal or commercial usage licence (depending on the service purchased).

Images may not be altered, filtered, or edited without written permission.

Commercial third-party use requires written consent.

8. Marketing & Portfolio Use

Unless otherwise agreed in writing prior to the session, Lola Garcia Photography reserves the right to use selected images for portfolio, website, social media, competitions, publications, studio samples and other promotional purposes.

If a client requires complete confidentiality and does not wish any images to be used for promotional purposes, this must be requested in writing before the booking is confirmed.

A confidentiality (non-promotion) fee will apply to compensate for the loss of promotional value. The fee varies depending on the type and scale of the commission and will be confirmed in writing before contract signing.

Once agreed, no images from that session will be used publicly.

9. Limitation of Liability

In the unlikely event of total photographic failure, liability is limited to the amount paid by the client.

Lola Garcia Photography is not liable for:

  • Venue restrictions

  • Weather conditions

  • Technical failures beyond reasonable control

  • Missed moments due to interference or time constraints

10. Force Majeure

The photographer is not liable for failure to perform due to circumstances beyond reasonable control, including but not limited to illness, accidents, natural disasters, government restrictions, or transportation issues.
